MINUTES OF AUGUST 11, 2005
LONG BEACH PLANNING COMMISSION
Be it remembered that a regular meeting of the Long Beach Planning Commission was begun and held in the Jeritza A. Pell City Hall Annex in said City at 7:00 p.m. on Thursday the11day of August 2005. The same being the time and place fixed for holding said meeting.
There were present and in attendance on said Commission and at the meeting the following named persons; Frank Olaivar, Tonda Yandell, Tony VanCourt, Dale Stogner, Frank Reed, Lew Powell, David Serrato, Joseph SweetApple, Planning Commission Advisor Bill Hessel and Minutes Clerk Shirlene Francis.
Commissioner Rod Rishel was absent the meeting.
There being a quorum present and sufficient to transact the business of the Planning Commission, the meeting was called to order at 7:00 p.m. and the following proceedings were had and done.

The Commission Chairman stated that all decisions made at this meeting would have to be ratified by the Mayor and Board of Aldermen at their next regularly scheduled meeting of August 16, 2005 and subject to a ten-day appeal for a Public Hearing.

Commissioner Yandell made motion seconded by
Commissioner Reed to approve the minutes of the Planning Commission dated July 28, 2005.

The first item to come before the Commission was Planning Commission approval request for a Home Occupation submitted by Ryan Lowery, as follows:

Mr. Ryan Lowery of 707 Dogwood Dr. Long Beach, MS., came forward for the request. He stated that he has an auto wholesale license, which allows him to purchase vehicles from an auto auction and sell to auto dealerships. He stated that his home would be only for paperwork, internet use and phones purposes. The Chairman asked Mr. Lowery if he had received a copy of the Home Occupation Ordinance Section 912, he stated he had.
Commissioner Stogner made motion seconded by Commissioner VanCourt and unanimously carried to approve the request for the Home Occupation; in accordance with the Zoning Ordinance Section 912 Home Occupation.

The next item to come before the Commission was a Public Hearing that was taken under advisement on July 28, 2005 and was submitted by Ms. Henrietta Lassabe.
The Commission moved to take this request under advisement due to insufficient information at that time.
Commissioner Yandell made motion seconded by Commissioner SweetApple and carried unanimously to reopen the Public Hearing.
Ms. Henrietta Lassabe of 5125 Mitchell Road, Long Beach MS., came forward for the request. Ms Lassabe stated to the Commission again that she is requesting to use a fifteen ft. (15’) alley to access her property in order to build a house. She provided documents indicating where her property lines are.
The Chairman opened the floor to public comments for anyone to speak in favor of the request, No one came forward

of 5216 Mitchell Road Long Beach, MS. came forward he stated that there continues to be a dispute of the exact location of where the fifteen ft. (15’) alley is located.

Mr. Kaletsch presented a map of the property in question in which he stated he obtained from the Harrison County Tax office. The map disputes the survey presented by Ms. Lassabe.
Ms. Lassabe came forward again and stated that she just wants to build a house on her four (4) acre property; she is willing to give fifteen ft. (15’) of her property to add to the alley making it thirty feet (30) in order to build her house. She stated that is where the discrepancies in the surveys are, her survey shows that she has the amount of space needed and other maps and surveys show differently. There was a judgment ruling for some property in that area affecting some adjoining property, a copy of that is on file in the Building Permits office in the City of Long Beach.
Commissioner Serrato made motion seconded by Commissioner Stogner to close the Public Hearing.
The Commission had much discussion of which survey presented is correct. The Commission stated only a surveyor could determine which is correct. The discussion went on about allowing her to build with access from the fifteen ft. (15’) alley.
After considerable discussion Commissioner Yandell made motion seconded by Commissioner SweetApple to approve the request to allow Ms. Lassabe to build a house that fronts a fifteen feet (15’) alley subject to the road being a minimum of thirty ft. (30’) wide and meeting all of the setbacks of the zoning ordinance.

The Chairman determining the majority of Yes votes ruled the motion passed.

There being no further business to come before the Planning Commission at this time Commissioner VanCourt made motion seconded by Commissioner Powell and unanimously carried to adjourn the meeting until the next regularly scheduled meeting in due course. The meeting was adjourned at 8:25p.m.
